The procedure for trademark extension
Trademark registration shall be valid for ten years from the date of application.
Term of registration for a trademark, well-known trademark is extended upon the request of the right holder to extend the term of registration of the trademark, well-known trademark (hereinafter - Application) for the next ten years in accordance with Article 15, paragraph 2 and Article 18-1, paragraph 5 of the Law.
The application shall be filed with the service provider within the last year of registration for a trademark, a commonly known trademark on form according to Annex 19 to these Rules.
The application is submitted in Kazakh or Russian.
The application is signed by the owner (right holder) or representative acting on the basis of a power of attorney.
The application shall be accompanied by:
1. a document confirming payment for the extension of the term of registration of the trademark;
2. a power of attorney (if the application is filed by the representative) or copies of the power of attorney (if the application is filed by the patent attorney).
The application and accompanying documents are submitted directly to the expert organization, sent by mail or electronic address of the enterprise.
The application and attached documents shall be considered within ten working days from the date of their receipt by the expert organization.
In case of submission of an incomplete package of documents according to paragraphs 49, 50 of these Rules, the applicant shall submit the required documents no later than 20 (twenty) working days from the date of sending the request of the service provider.
If the relevant documents are not submitted, the term of registration of the trademark, the well-known trademark is not extended, as the applicant is notified.
Recovery of missed payment period for renewal of trademark registration
Pursuant to article 15, paragraph 3 of the Law, the time limit for filing an application may be reinstated on the request of the owner submitted within six months after the expiration of the registration period. It is necessary to pay the services of an expert organization for the recovery of the missed payment period by the applicant.
In case of extension of the period of validity of registration of a trademark, well-known trademark, relevant entries are entered into the State Register of Trademarks of the Republic of Kazakhstan, published in the bulletin, and to the owner/representative in electronic form shall be sent an appropriate Notice of Extension of the Term of Validity of the Trademark according to Annex 20 to this Regulation, a commonly known Trademark according to Annex 21 to this Regulation.
