Stages

In the Republic of Kazakhstan there is a two-stage examination system, which consists of two stages – examination of an application and substantive examination.

An examination of an application for the grant of a patent for an industrial design is carried out after the application has been received by the expert organization.

At the stage of examination of an application, the existence of application’s documents is checked; the date of filing the application and the priority date are established.

After the examination of an application, the expert organization conducts a substantive examination, in which it is determined whether the industrial design is patentable.

In the course of the substantive examination, a patent information retrieval through the open information sources, the patent base of Kazakhstan and the departments of the developed countries of the world is carried out. The search is conducted to a depth of 20 years.
