ACCELERATED EXAMINATION ON APPLICATIONS FOR THE ISSUE OF PATENTS FOR THE INVENTION

In accordance with paragraph 13-1 of Article 22 of the Patent Law of the Republic of Kazakhstan dated July 16, 1999 No. 427, at the request of the applicant, the examination of the application for the grant of a patent for an invention is carried out in an accelerated form within six months, if the claimed invention relates to objects for which favorable conditions for patenting are provided.

In accordance with paragraph 88 of the Rules for the examination of applications for industrial property objects (approved by order of the Minister of Justice of the Republic of Kazakhstan No. 1349 dated August 29, 2018, as amended in accordance with the order of the Minister of Justice of the Republic of Kazakhstan No. 1630 dated December 26, 2018), for an accelerated examination objects for which favorable conditions for patenting are provided include:

• inventions in the field of renewable energy sources (solar energy, wind energy, hydrodynamic water energy, geothermal energy: heat of soil, groundwater, rivers, reservoirs, as well as anthropogenic sources of primary energy resources: biomass, biogas and other fuels from organic waste), aimed to reduce emissions of pollutants into the environment and used for the production of electrical and (or) heat energy;

• inventions in the field of information and communication technologies;

• inventions in the field of diagnostics, prevention and treatment of infectious diseases, with the threat of the emergence and spread of which restrictive measures are introduced, including quarantine, as well as oncological diseases.

Accelerated examination for the grant of a patent for an invention includes an accelerated formal examination within ten working days, an accelerated information search within two months, an accelerated substantive examination within three months.

A petition for an accelerated examination of an application for the grant of a patent for an invention shall be submitted by the applicant upon filing the application.

Simultaneously with the application, a document confirming the payment for the examination is submitted.

If a document confirming payment for an accelerated formal examination, examination in essence is not submitted, the application is considered not submitted, about which the applicant is sent a corresponding notification within five working days from the date of recognition of the application as not submitted.

The term for calculating the accelerated examination of the application is suspended until the receipt of the necessary documents from the applicant, including replies to notifications and examination requests, documents confirming the corresponding payment.
