Draft amendments to the intellectual property legislation were considered in conjunction with the European experts at the Round Table

The Round table on the topic "On amendments and additions to some legislative acts of the Republic of Kazakhstan on improvement of legislation in the field of Intellectual Property" was held in the Majilis.
The meeting was opened by the Chairman of the Committee on Legislation and Judicial-Legal Reform N.Abdirov. In his speech, he noted that a year has passed as Kazakhstan signed an agreement on expanded partnership with the European Union. Republic of Kazakhstan has been consistently pursuing a policy for the phased introduction of the positive experience of developed OECD countries.
Kazakhstan has become a full member of the World Trade Organization. Initiatives of Heads of five states for economic integration and the common customs territory of the Eurasian Economic Union are implemented.
The obligation to provide suitable protection of intellectual property and ensure the freedom of their turnover in the market in compliance with the rights of copyright holders provided in those international commitments.
There were following speakers: S. Tlevlessova, President of the Eurasian Patent Office (EAPO) of the Eurasian Patent Organization; Federico Birocchi, Head of Trade Section of the European Union Delegation to Kazakhstan; Paivi Lahdesmaki, Head of Legal Section of Hague Registry of WIPO; Marion Guth, Regional advisor of the Embassy of the French Republic to the Russian Federation on Intellectual Property Issues in the CIS countries and Georgia; representative of the National Institute of Industrial Property of France; Klaus Bacher, Judge from German Federal Court of Justice; Oliver Schon, Judge at the District Court Munich I.
Acting with the report on the draft law, Deputy Minister of Justice E.Azimova noted that the draft law provided for the following major novels. Firstly, the creation of a single-level intellectual property registration system by delegating the organization of the expert authority on registration of intellectual property rights. Second, the expansion of opportunities for pre-trial registration disputes. In this context, it is proposed to endow the Board of Appeal of the Ministry of Justice with additional powers. Third, the draft law provided for rules aimed at ensuring the rights of copyright holders to receive compensation for the unlawful use of a trademark. Fourth, the draft law proposes to publish a trademark application with the date of their admission to the expert organization.
In addition, the proposed amendments aimed at simplifying the procedure for registration of license contracts for industrial property.

Consideration of the draft law will continue in the framework of the working group on the draft law.
