On the official website of RSE "NIIS" http://kazpatent.kz/ru the section "About us" - "Tariffs" contains the Order of the Director of RSE "NIIP" dated by 3rd January 2019 with the current prices for works and services provided by the expert organization.
At the same time, the prices for works and services provided earlier remained the same.
In addition, due to changes in the legislation in the field of industrial property, the order of payment for certain services was changed.
As you know, trademark registration is carried out at the end of two stages of examination: preliminary and full.
Previously, the legislation provided for the possibility of phased payment:
Separate documents confirming the payment were submitted to the applications for these procedures.
In the current version of the Act "on trademarks, service marks and appellations of origin" paragraph 3) paragraph 2 of article 9 provides that the application must be accompanied by a copy of the document confirming the payment of the service for the examination.
Thus, the provision of a payment document is a prerequisite for the application. Moreover, the payment document must confirm the payment of two stages of the examination at the same time.
At submission of the copy of the document confirming payment of one of stages of examination, the application to consideration cannot be accepted.
We also inform that at the preliminary examination does not exclude the possibility of the termination of the proceedings, including at the request of the applicant. In such cases, the amount paid for the full examination will be credited to the advance or returned to the applicant.
