National Institute of Intellectual Property
Today, on October 9, 2019, a working meeting with the leadership of the Center for Forensic Expertise of the Ministry of Justice of the Republic of Kazakhstan was held at the National Institute of Intellectual Property.
The main topic of the meeting was the issues of harmonization of forensic commodity expertise with bylaws in the field of registration and protection of trademarks.
At the meeting, welcoming speeches were made by the director of the RSE “NIIP” Yerbol Ospanov and the head of the Office for Monitoring the Activities of the Central Intelligence Center of the Department of Organization of Expert Activities of the Ministry of Justice of the Republic of Kazakhstan Temirbolat Kozhamzharov.
Presentations were made by the head of Department of development and international cooperation Aydin Artykova on the topic: "An overview of the activities of RSE "NIIP" and by acting head of Department of trademarks, appellations of origin and industrial designs, Aigerim Sashken on the topic: "Determination of identity and similarity to the point of confusion to trademarks legislation in the field of intellectual property."
During the meeting, the parties discussed the methods of determining the identity and similarity to the degree of confusion of trademarks used by the parties.
Assemgul Abenova, the head of the Industrial Property Office of the Department of Intellectual Property Rights of the Ministry of Justice of the Republic of Kazakhstan, voiced the main controversial issues arising in the establishment of signs of identity or similarity of trademarks during the examinations.
Following the discussion, the meeting agreed to jointly develop a methodology for determining the similarity to the degree of confusion of trademarks.
