A round table was held with patent attorneys of Kazakhstan on the main changes in legislation

Today, on July 14, 2022, Qazpatent together with the Department of Intellectual Property of the Ministry of Justice of the Republic of Kazakhstan held a round table on "Improving the legal protection of industrial property: major changes in legislation" with the participation of patent attorneys of Kazakhstan.

The Head of the Industrial Property Department of the Intellectual Property Department of the Ministry of Justice of the Republic of Kazakhstan Adil Ismagulov and the Deputy Director of Qazpatent Aidyn Artykova made a welcoming speech. They congratulated the participants on the 30th anniversary of the Patent System of Kazakhstan and wished fruitful work. Also, the welcome speech was given to Eurasian patent attorney Nurgaisha Sakhipova and member of the Union of Patent Attorneys of the Republic of Kazakhstan Zhanna Abylkhanova.

During the round table, the head of the Legal Support Department of Qazpatent Andrey Trinkolenko presented a report on the main changes in legislation in the field of intellectual property, which include the addition of the current list of industrial property objects with another object - "geographical indication", the introduction of short-term protection for unregistered industrial designs and the "opposition system".

Altynai Taisheva, Deputy Head of the Department of Trademarks, Appellations of Origin of Goods and Industrial Designs of Qazpatent, spoke on the topic "Examination of industrial designs: International practice and the possibility of transition to local novelty". She focused on the procedure for obtaining a patent for an industrial design, the criteria for patentability of an industrial design, ways to protect the rights of applicants and patent holders.

Following the presentations of Qazpatent employees, patent attorneys voiced the issues they face in the process of law enforcement practice when filing applications, appealing decisions in the appeals board and judicial instances. In addition, patent attorneys have made proposals to detail the provisions of the Law "On Trademarks" and the Patent Law. The main questions were aimed at the possibility of detailing in the by-laws the use of a domain name, the recognition of an industrial design as publicized, and norms relating to public interests, principles of humanity and morality.
