The EAPO Administrative Council decided to launch a Eurasian industrial design

The thirty-seventh (tenth extraordinary) meeting of the Administrative Council of the Eurasian Patent Organization (AC EAPO) took place today, on April 12, 2021.

The meeting was opened by M.Kh. Ismoilzoda, the Chairman of the AC EAPO, the plenipotentiary representative of the Republic of Tajikistan in the AC EAPO, Director of the National Center for Patents and Information, Ministry of Economic Development and Trade of the Republic of Tajikistan.

The meeting was attended by plenipotentiaries in the AC EAPO of the Republic of Belarus, the Russian Federation, the Republic of Tajikistan, Turkmenistan, deputy plenipotentiaries in the AC EAPO of the Republic of Azerbaijan, Republic of Armenia, Republic of Kazakhstan, Kyrgyz Republic, as well as members of the delegations of the Republic of Belarus, Republic of Kazakhstan, Kyrgyz Republic, Russian Federation, Republic of Tajikistan.

Members of the Administrative Council approved Part II "Industrial Designs" of the Patent Regulations to the EAPC and the Statute on Fees of the Eurasian Patent Organization for legally significant and other actions taken in relation to applications for granting Eurasian patents for industrial designs and to Eurasian patents for industrial designs.

The issues on the distribution of fees paid under the Protocol, as well as on the date of the start of accepting applications for Eurasian industrial designs were considered. According to the EAPO, the acceptance of applications is scheduled to begin on June 1, 2021.

In general, the Protocol provides an applicant with the opportunity to obtain legal protection for an industrial design on the basis of a single application filed with the EAPO.

We remind you that the Protocol on the Protection of Industrial Designs to the Eurasian Patent Convention (EAPC), adopted on September 9, 2019 at the Diplomatic Conference in Nur-Sultan, entered into force on March 17, 2021 for Kyrgyzstan, Azerbaijan and Armenia, on April 11, 2021 for Russia and for Kazakhstan on April 12, 2021. The document was ratified in Tajikistan, the issue of joining the Protocol is being considered in Belarus and Turkmenistan.
